3. TRANSFERS.

The Personal Information of the USER may be processed within the Mexican Republic or abroad.

VYNMSA may transfer your Personal Information to third parties in terms of article 37 of the Federal Law on Protection of Personal Information held by Private Individuals when: (i) the transfer is made within controlling, subsidiary or affiliate companies under the common control of the responsible party, or a parent company or any other company of the responsible group that operates under the same internal policies and processes; (ii) the transfer is contained in a Law or Treaty to which Mexico is a party; (iii) the transfer is necessary due to an executed agreement or to be executed on behalf of the owner’s interest, by the responsible and a third party; (iv) the transfer is necessary or legally required to protect the public interest, or the justice enforcement and administration; (v) the transfer is required for the acknowledgement, exercise or defense of a right in a judicial process; and/or (vi) the transfer is required for the maintenance or compliance of a legal relationship between the responsible party and the USER, owner of the Personal Information.

5. RESPONSIBILITY LIMIT.

VYNMSA shall not be responsible in any case, to the maximum extent allowed by applicable laws, for any direct or indirect damage, special, incidental or consequential, derived or related to: (i) the use or execution of the Website; (ii) a delay or unavailability of the Website usage; (iii) the supply or lack of supply of any information services, graphics contained or published on or through the Website; (iv) of the information’s update or lack of update; (v) the information has been altered or modified, in whole or in part, after being included in the Website; (vi) any other aspect or characteristic of the information contained or published on the Website or through the links eventually included thereon; (vii) the services’ provision or lack of provision.
