1. IDENTITY AND SCOPE.
The USER acknowledges that it freely and willingly enters and provides its personal information (“Personal Information” or “Personal Information”), to the Website and/or VYNMSA
VYNMSA is responsible for the processing of the Personal Information collected by itself and regarding the privacy right and informative self-determination of individuals in accordance with the Constitutional article 16 and the provisions contained in the Federal Law on Protection of Personal Information held by Private Individuals (hereinafter the “LFPDPPP”) and its Regulation, complying with the principles of legality, consent, information, quality, purpose, loyalty, proportionality and responsibility.
2. PURPOSE OF THE PROCESSING OF PERSONAL INFORMATION.
VYNMSA, is a leading company in the construction and development industry of industrial parks in Mexico that seeks to use the Personal Information of the citizens of the Mexican Republic such as, complete name, domicile, date and place of birth, e-mail, Unique Population Registry Code, Federal Taxpayer’s Registration, fixed telephone and/or cellphone number, billing information such as (Name of the individual or legal entity, TAX ID number or code, tax domicile, zip code, population), employer, nationality, place of birth, occupation, among others, for the following purposes:
The Personal Information of the USER may be processed within the Mexican Republic or abroad.
VYNMSA may transfer your Personal Information to third parties in terms of article 37 of the Federal Law on Protection of Personal Information held by Private Individuals when: (i) the transfer is made within controlling, subsidiary or affiliate companies under the common control of the responsible party, or a parent company or any other company of the responsible group that operates under the same internal policies and processes; (ii) the transfer is contained in a Law or Treaty to which Mexico is a party; (iii) the transfer is necessary due to an executed agreement or to be executed on behalf of the owner’s interest, by the responsible and a third party; (iv) the transfer is necessary or legally required to protect the public interest, or the justice enforcement and administration; (v) the transfer is required for the acknowledgement, exercise or defense of a right in a judicial process; and/or (vi) the transfer is required for the maintenance or compliance of a legal relationship between the responsible party and the USER, owner of the Personal Information.
It shall be understood that the USER has granted its consent if the latter does not express its disagreement for its Personal Information to be transferred.
VYNMSA with business address located on Monterrey, N.L., Mexico, by means of its Responsible Party for the Processing of Personal Information, provides the following e-mail address firstname.lastname@example.org, as well as the telephone number (81) 83567978, in order to manage any request in regards to the access rights, amendment, cancellation or disagreement of the Personal Information (ARCO rights), as well as to manage any withdrawal of consent request for the processing of Personal Information, same that shall be managed pursuant the terms established in the LFPDPPP. Such request shall include: (i) the (ARCO) right to be exercised, (ii) name and/or corporate name, RFC and contact number, (iii) documents that prove the capacity (copy of an official ID or power of attorney in public deed); the request shall be processed and replied, by e-mail or at the appointed domicile, within 2 (two) days following to the reception of the same.
Should the USER consider that its Personal Information protection right has been harmed by any conduct of VYNMSA, the USER shall file the corresponding claim or complaint before the IFAI through the website www.ifai.org.mx.
5. RESPONSIBILITY LIMIT.
VYNMSA shall not be responsible in any case, to the maximum extent allowed by applicable laws, for any direct or indirect damage, special, incidental or consequential, derived or related to: (i) the use or execution of the Website; (ii) a delay or unavailability of the Website usage; (iii) the supply or lack of supply of any information services, graphics contained or published on or through the Website; (iv) of the information’s update or lack of update; (v) the information has been altered or modified, in whole or in part, after being included in the Website; (vi) any other aspect or characteristic of the information contained or published on the Website or through the links eventually included thereon; (vii) the services’ provision or lack of provision.
VYNMSA, is not, nor shall be responsible of the usage, content, truthfulness, quality or accuracy of the information contained in the Website, including without limitation, such published by VYNMSA, and/or provided by the USER by any means.
The USER hereby expressly releases VYNMSA of any responsibility derived from the foregoing and is obliged to indemnify and hold harmless REIT PROPIEDADES INDUSTRIALES, S. DE R.L. DE C.V. (“VYNMSA”), covering the damages applicable to the claims that: (i) any third party may present against it; (ii) arise from any judicial and/or administrative requirement, claim and/or proceeding derived from the default of the USER’s obligations regulated in the current legislation and/or those that may acquire or had acquired.
VYNMSA, may unilaterally, at any time, make corrections, additions, improvements or amendments to the content, presentation, information, services, areas, databases and other elements of the Website, in order to comply with the current legislation and/or when considered as convenient. The USER hereby acknowledges that it has no right to any claim, compensation and/or payment of damages caused by the executed changes.
7. LIMITATION OR REVOCATION FOR THE PROCESSING OF YOUR DATA.
At all times, you may limit the usage and disclosure of your Personal Information and/or revoke the consent you have granted us for processing of the same, in order for us to stop using them. To this extent, it is mandatory that you present your request via e-mail to email@example.com including in the subject of the e-mail “Limitation or Revocation for the processing of my data” complying with the same requirements and procedure set forth for the exercise of the Arco rights.
However, in regards to the revocation of the processing of Personal Information, it is important that you consider that not in all events we may be able to answer your request or terminate the usage immediately, since it is possible that due to any legal obligation, we require to continue processing your Personal Information. Moreover, you should consider that for certain purposes, the revocation of your consent will imply that we cannot continue to provide the service you requested.
